By using our site, you agree that you accept these General Terms and Conditions which are applicable to all orders placed through LeesGourmetDirect.com and all business conducted with LeesGourmetDirect.com.

Orders and Payment

Orders can be placed 24 hours a day, seven days a week via our web site. We are available to answer questions and assist with orders during our normal office hours Monday - Friday from 9:00 am - 5:00 pm eastern time at (404) 460-7008.

Payment types accepted on our site include MasterCard, Visa, Discover, or American Express credit cards. Sales taxes are not added to your order, but that may change in the future (remove?). If you have any problems completing an order, please call us at (404) 460-7008 and we will be glad to assist! Outside of business hours please send us an email at [email protected] and we will get back to you as soon as possible.

Product Availability

Due to the fact the specialty gourmet products that we stock are hard to find, unique items, sometimes limited availability and irregular deliveries from our suppliers do come up. Despite our best efforts, occasionally some products will not be available on the expected ship date. If there are any issues with availability of any products in your order, we will contact you by email or phone prior to shipment to discuss possible substitutions.

Order Fullfilment

All orders placed before 11:59PM PST will ship the next available shipping day. During checkout, you’ll see an order summary that indicates when your order is expected to be delivered, which shipping option is selected, and the shipping cost (our system defaults automatically to the least expensive available option based on the items selected and your ship to address). You’ll also get an order confirmation email showing the expected shipping date and arrival date.

If you need an order delivered on a particular day, please let us know in your order message or call us beforehand at (404) 460-7008. Please be aware that we are not always able to accommodate these requests due to shipping schedules, especially in the instance that an order would need to be shipped over a weekend or holiday. Address Change or Incorrect Address

Upon placing your order, an order confirmation is sent to the email address you provide. The email order confirmation functions as your invoice and includes the shipping and billing address. If you notice you have mistakenly entered incorrect shipping address information please contact us immediately at (404) 460-7008 or via email at [email protected]

Delivery Policy and Signature Requirement

All orders are shipped without a signature requirement. You will receive a shipping confirmation once your order has shipped with tracking information and expected delivery date. Please ensure someone is there to receive the shipment as we cannot be held responsible for packages that are not left due to the driver determining the package is not secure, gated delivery locations that are not accessible, condos or apartments that are not accessible or packages that are stolen after delivery or that have spoiled due to exposure to the elements.

We also cannot be held responsible for any delay in delivery due to weather (hurricane, tornado, floods, snow, ice etc.), shipments delayed due to ‘acts of god’ are not eligible for a refund or credit.

Order Cancellation and Modification

While we will always do our best to accommodate requests, once your order has been packed and shipped we are not able to cancel or modify it. Orders that are already in transit are not able to be rerouted, so please be sure your shipping address is correct when you place your order.

Returns and Refunds

Unfortunately we are not able to accept returns of perishable items or vulnerable non-perishable items, like crackers, cookies or soft packaged items. We are only able to accept the return of canned or hard packaged food items. If you have a problem with an order or need to return an item, claims must be made within 48 hours of receiving the product. Please note that shipping costs are not refundable. Return shipping will be at the buyer’s expense, but we will process refunds once we have received and verified it.

Defective or Damaged Mechandise

We work very hard to assure your order is received intact and in proper condition. However, we understand that sometimes things happen and items can get damaged in transit. In the event that you receive a defective or damaged product, please contact us immediately. Please do not throw away or discard any items, as we may need the item(s) to be returned to us in order to process a refund or store credit or send a replacement. The easiest way to help us resolve any defective or damaged merchandise is to take a picture of the item and email it to us at lees[email protected] or call us at (404) 460-7008.

Invalidity - Force Majeure - Applicable law - Competent Courts

If any one of the clauses of these General Terms and Conditions are, for whatever reason, declared invalid or invalidated for any reason, this will not affect the application or the validity of the other clauses. The clause declared invalid, or invalidated, will be replaced by the disposition closest to that clause. Neither LeesGourmetDirect.com nor the Customer will be held liable for any failure to perform their obligations as a result of a force majeure beyond their control, including but not limited to the following: war, riot, insurrection, interruption of transport systems, problems relating to export and import, strikes, lock-out, shortage of Products, fire, earthquakes, storms or floods. These General Terms and Conditions are governed exclusively by United States law. All litigation or disputes between the parties shall be brought only before the competent court in the United States.
